We Pick The Winner

There is no random winner by a computer here, we’re picking the winner based on motivation. We want to do something that gets us excited, thinking and moving on more than a business level. Let us know your cause, your “next-big-thing” idea or simply why you think you deserve an Apex built website.

1. ACCEPTANCE OF TERMS
Apex Audio Visual Productions CC, provides its service to you, subject to the following terms, which may be updated by us from time to time without notice to you.

2. ELIGIBILITY
The contest is open to anyone in any capacity whether private, public or as a business who meets the various eligibility criteria for the awards. Applicants under the age of 18 must have a parent or guardian
sign the Apex Multimedia waiver, available on winning. Applicants over the age of majority must be able to present valid personal identification upon request.
Employees of Apex Audio Visual Productions CC, their respective affiliates and associates, and any such
employees’ immediate family members and persons with whom such employees are excluded from this contest.

3. “REGISTRATION” OBLIGATIONS
You agree to provide true, accurate, current and complete information about yourself and/or your chosen business/institution upon winning. If you provide any information that is untrue, inaccurate, not current or incomplete, Apex Multimedia has the right to suspend or terminate your participation in the Free Website promotion and services without further obligation to you.
Entries must be completed by “liking”, “sharing” and “commenting” on the following link “https://www.facebook.com/photo.php?fbid=10150899182933696&set=a.10150092658978696.311233.198915303695&type=1&theater”. Incomplete entries will be disqualified.
All entries shall become the property of Apex Multimedia upon submission. Apex Audio Visual Productions is not responsible for lost, misdirected or delayed entries. Apex Multimedia reserves the right to accept or reject any entries received prior to the deadline should, at the sole discretion of Apex Multimedia.

4. JUDGING AND AWARDS
i. Decisions of Apex Multimedia are final and may not be challenged in any jurisdiction for any
reason whatsoever.
ii. The winning person/company/institution, or a representative member thereof, are not expected to attend the awards ceremony and accept their award. If the team, or a member of, does not attend, the prize may still be awarded electronically over Email.
iii. The prize(s) must be accepted as awarded.
iv. By accepting an award, the winner authorizes the use, without additional compensation of his or her name and/or likeness and/or voice/photograph and/or municipality, state, and nation of residence and/or details included in submissions for promotion and/or advertising purposes in any manner and in any medium (including without limitation, radio broadcasts, newspapers and other publications and in television or film releases, slides, videotape, distribution over the internet and picture date storage) which Apex Multimedia may deem appropriate.
v. In accepting an award, the winner and any affected colleague(s) and/or guest(s) acknowledges that Apex Multimedia may not be held liable for any loss, damages or injury howsoever associated with accepting or using the award and any associated benefits thereto.

5. PRIVACY POLICY
Registration data and certain other information about you is subject to privacy protection when requested. You understand that through your use of our registration process you are consenting to the collection, use and disclosure of this information, as permitted by this agreement, including the transfer of this information and use by Apex Multimedia and affiliates.
Please note that all entries submitted will be considered public information and selected entries will be posted on the Apex Multimediawebsite (www.apexmedia.co.za) for viewing, along with a limited amount of personal information on the design team (eg: names of the entrants who submitted each project). Apex Multimedia is not responsible for any unauthorized use of your entry by visitors to this or related websites, including but not limited to
www.facebook.com, www.apexmedia.co.za and the websites of Apex Multimedia’s sponsors and affiliates.

6. GENERAL INFORMATION
ii. Choice of Law and Forum
Apex Multimedia’s services and the relationship between you and Apex Multimedia shall be governed by the laws of South Africa without regard to its conflict of law provisions. You and Apex Multimediae agree to submit to the personal and exclusive jurisdiction of the courts located within the province of
Johannesburg, South Africa.
iii. Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our service or related to Apex Multimedia must be filed within one (1) year after such claim or cause of action arose or be forever barred.
iv. English Language
The parties hereto have agreed that this Agreement and any of its accessories, including notice, be written in the English language. Les parties aux présentes ont exigé que ce contrat et ses accessoires, y compris tout avis, soient rédigés en anglais.
v. Content Use
All materials published on or connected to Apex Multimedia website(s) are the property and copyright of Apex Audio Visual Productions (unless stated otherwise) and shall not be copied, reproduced, duplicated, sold, traded, exploited or distributed without Apex Multimedia’s prior written authorization. This includes, but is not limited to, branding, logos, graphics, website design, and content. Certain graphics throughout the website are used under license from third parties not specifically noted on this site and
are not to be copied, reproduced or altered in any way.
Neither the author of any of this information nor Apex Multimedia makes any representation as to the particular construction methods identified herein and make no endorsement of any construction method so identified.

7. INDEMNITY
You agree to indemnify and hold Apex Multimedia and their affiliates, sponsors, officers, partners, and employees harmless from any claim or demand, including legal fees, made by any third party due to or arising out of information you submit, your use of our service and your connection to our service.

8. FINALITY
Apex Audio Visual Productions reserves the right to reschedule, withdraw or terminate this contest or any
component herein at any time without prior notice or explanation and without further obligation.
